comply with accounting and other legal obligations.

We use third-party payment providers to process payments.

7. Newsletter
You may subscribe to the Datum Coffee newsletter.
Where newsletter subscription is based on consent, we process your email address and any other information voluntarily provided for the purpose of sending newsletters and marketing communications.

You may withdraw your consent at any time by using the unsubscribe link contained in our emails or by contacting us at hello@datum.coffee.
Withdrawal of consent does not affect the lawfulness of processing carried out before withdrawal.
8. Purchase of the Speciality Pass and Newsletter
Purchasing the Speciality Pass does not automatically constitute consent to receive marketing communications where separate consent is legally required.
Transactional emails relating to your purchase, such as order confirmations, payment information, withdrawal information or other communications necessary for the contractual relationship, may be sent without separate marketing consent where permitted by law.
Marketing communications are sent in accordance with applicable laws, including the Austrian Telecommunications Act 2021.

1. Scope
These Terms & Conditions apply to the purchase of the Speciality Pass.
The Speciality Pass is offered to consumers and other customers through the Datum Coffee website.
2. What the Speciality Pass Provides
The Speciality Pass provides the purchaser with access to special communications and information relating to Datum Coffee and its planned Kickstarter campaign.
Depending on the campaign and the information available at the relevant time, this may include:
early information about the planned Kickstarter campaign;
advance notification of the campaign launch;
access to selected campaign-related information before it is publicly available;
special updates relating to Datum Coffee products and the Kickstarter campaign; and
other benefits expressly communicated by Datum Coffee in connection with the Speciality Pass.
The specific benefits of the Speciality Pass may be updated or further specified by Datum Coffee from time to time.
3. No Product Purchase or Reservation
The Speciality Pass is not:
a purchase of a Datum Coffee product;
a pre-order;
a reservation of a product;
a deposit or down payment;
a Kickstarter pledge; or
a guarantee of the right to purchase a product.
The purchase of the Speciality Pass does not create an entitlement to receive a Datum Coffee coffee machine, grinder or any other product.
4. Kickstarter Campaign
Datum Coffee currently intends to launch a Kickstarter campaign.
However, the purchase of the Speciality Pass does not guarantee:
that a Kickstarter campaign will be launched;
that the campaign will be successfully funded;
that a particular product will be offered;
that a particular product specification will be maintained;
that a particular price will be offered;
that a particular number of products will be available; or
that products will be delivered by a particular date.
Any future Kickstarter campaign will be subject to its own terms and conditions and the terms of the Kickstarter platform.
The Speciality Pass does not constitute a Kickstarter pledge.
5. Price
The Speciality Pass is a one-time payment.
Unless otherwise stated at checkout, the Speciality Pass does not involve any recurring subscription fee or automatic renewal.
Any applicable taxes are included in the displayed consumer price where required by law.
6. Payment
Payment is processed through the payment methods made available on our website.
Depending on the selected payment method, payment may be processed by third-party payment providers such as Stripe, PayPal, Klarna, Apple Pay or Google Pay.
The availability of individual payment methods may vary depending on the customer's location, device and other factors.
7. Order and Contract Formation
The presentation of the Speciality Pass on our website does not constitute a legally binding offer by Datum Coffee until the customer submits an order.
By clicking the final order button indicating a payment obligation, the customer submits a binding offer to purchase the Speciality Pass.
The contract is concluded when Datum Coffee accepts the order, normally by sending an order confirmation by email or by otherwise confirming the purchase.
8. Delivery of the Speciality Pass
The Speciality Pass is provided electronically.
The benefits associated with the Speciality Pass are made available through the email address provided during the purchase process or through another electronic communication method specified by Datum Coffee.
The customer is responsible for providing a valid email address and ensuring that emails from Datum Coffee can be received.
9. Newsletter and Marketing Communications
The Speciality Pass may include special communications relating to Datum Coffee and its Kickstarter campaign.
Where separate consent is required for marketing communications under applicable law, such consent will be requested separately.
Transactional communications relating to the Speciality Pass may be sent where necessary to perform the contract or comply with legal obligations.
10. Statutory Right of Withdrawal
Consumers have a statutory right to withdraw from the contract within 14 days without giving any reason, subject to the conditions set out in our Withdrawal Policy.
The withdrawal period generally begins on the day on which the contract is concluded for services.
Further information is provided in our separate Withdrawal Policy.
11. Refunds After the Withdrawal Period
Once the applicable statutory withdrawal period has expired, the purchase price is generally non-refundable, except where a refund is required by applicable law.
This does not affect any mandatory statutory rights of consumers.
12. Changes to the Speciality Pass
We may reasonably modify the content, presentation or method of delivery of the Speciality Pass where this is necessary due to technical, operational, legal or other legitimate reasons.
We will not use such changes to deprive customers of the essential benefits of the Speciality Pass.
13. Availability and Discontinuation
We reserve the right to discontinue the sale of new Speciality Passes at any time.
Discontinuation of sales does not affect contracts that have already been concluded, subject to applicable law.
14. Liability
Nothing in these Terms & Conditions excludes or limits liability where such exclusion or limitation is prohibited by applicable law.
In particular, mandatory consumer rights remain unaffected.
To the extent legally permissible, Datum Coffee shall not be liable for indirect losses or damages that were not reasonably foreseeable at the time the contract was concluded.
15. Intellectual Property
All content provided through the Speciality Pass, including text, graphics, images, branding and other materials, remains the property of Datum Coffee OG or its respective licensors.
The content may only be used for personal, non-commercial purposes unless otherwise agreed.
16. Applicable Law
To the extent legally permissible, Austrian law shall apply.
Where mandatory consumer protection provisions of the country in which a consumer has their habitual residence apply, those provisions remain unaffected.
17. Severability
If any provision of these Terms & Conditions is or becomes invalid or unenforceable, the remaining provisions shall remain unaffected.
The invalid or unenforceable provision shall be replaced by a valid provision that comes as close as legally possible to the intended economic purpose.
Withdrawal Policy.
1. Right of Withdrawal
If you are a consumer, you have the right to withdraw from the contract for the purchase of the Speciality Pass within 14 days without giving any reason.
The withdrawal period is 14 days from the day on which the contract is concluded.
To exercise your right of withdrawal, you must inform:

of your decision to withdraw from the contract by means of a clear statement, for example by email.
To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.
2. Effects of Withdrawal
If you withdraw from the contract, we shall reimburse all payments received from you in connection with the contract without undue delay and, in any event, no later than 14 days from the day on which we are informed about your decision to withdraw from the contract.
We will normally use the same payment method that you used for the original transaction, unless we have expressly agreed otherwise with you.
You will not incur any fees for the reimbursement.
3. Refund Processing
Where possible, refunds will be processed through the original payment provider and payment method.
Depending on the payment provider, the time required for the funds to appear in your account may vary.
4. After the Withdrawal Period
After the statutory withdrawal period has expired, the Speciality Pass is generally non-refundable.
This does not affect any mandatory statutory rights or claims that cannot legally be excluded.
5. Online Withdrawal Function
For contracts concluded through our online shop, we may provide an online withdrawal function where required by applicable law.
From 1 October 2026, Austrian law requires an online withdrawal function for certain consumer contracts concluded through an online user interface. Where applicable, this function will be made available in accordance with the statutory requirements.
